1. INTRODUCTION

1.1 These terms and conditions shall govern your use of our website, www.soulbeautyacademy.co.uk  (the “Website”), social media pages being our Facebook, Instagram  or any other social media pages maintained by the company from time to time (the “Social Media”) and any booking made through the Website, by Phone or in-person at our Salon (a “Booking”) and the terms and conditions relating to any beauty treatment services provided by us (the “Services”) at the Soul Beauty & Training Academy salon at Unit 8 Mousloe Business Centre, Cranfield Rd Newport Pagnell MK16 0FJ  (the “Salon”) .

1.2 The term “we” means Soul Beauty & Training Academy LTD  and all subsidiaries, the owner and operator of the Website, whose registered office is at 12 Maida Vale ,Milton Keynes , MK10 9RF, England and whose company registration number is 16119895 (“us” and “our” will be construed accordingly).     

1.3 The term “you” refers to the user or viewer of our Website, Social Media, or any person who makes a Booking or receives Services (and “your” will be construed accordingly).

1.4 By using our Website, Social Media or making a Booking, you agree to accept these terms and conditions. If you disagree with any of these terms and conditions, you must not use our Website, Social Media or make a Booking.

1.5 You must be at least 16 years of age to make a Booking.

1.7 Should you be making a Booking on behalf of another person (or if you transfer your Booking to another person), by making the Booking you confirm to us that you have their express permission to do so and you have their express agreement to all terms listed herein and elsewhere related to the Booking. Should such a person dispute their agreement to such terms or raise a claim of any kind, you indemnify us and hold us harmless from all damages.

1.8 The terms herein shall continue to apply to any changes that you make to a Booking including adding additional Services, removing Services, substituting Services or amending the recipient of Services whether such whether such changes are made online, by phone or in-person.

2. COPYRIGHT

2.1 This Website and Social Media contains content which is owned by or licensed to us (the “Content”). This Content includes, but is not limited to, the information, design, layout, look, appearance and graphics.

2.2 You are granted a licence to use the Content subject to the restrictions described in these terms and conditions.

2.5 All Content and material contained in this Website and Social Media is and shall always remain the copyright of Soul Beauty & Training Academy Limited.

2.6 You must retain and must not delete or remove all copyright notices and other proprietary notices placed by us on any Content.

3. LICENCE TO USE THE WEBSITE

3.1 You may:

(b) download pages from our Website for caching in a web browser.

(c) print pages from our Website; subject to the other provisions of these terms and conditions.

5. USER REGISTRATION

5.1 To register or make a Booking on our Website, you must be at least 16 years of age.

5.2 You may register with our Website by completing and submitting the account registration form on our Website, and clicking on the verification link in the email that the Website will send to you.

5.3 If you register for an account with our Website, you will be asked to choose a username  and password.

5.4 You must not use your account or user ID to impersonate any other person.

5.5 You must keep your password confidential.     

5.6 You must notify us in writing immediately if you become aware of any disclosure of your password.

5.7 You are responsible for any activity on our Website arising out of any failure to keep your password confidential and may be held liable for any losses arising out of such a failure.

  • Beauty services ( tint ,waxing, manicure, pedicure, makeup, permanent makeup treatments )
  • Training courses

These Terms and Conditions apply to all services offered on the website

6.1 Booking Beauty Services & Prepayment Policy

To secure your appointment, a 100% prepayment is required at the time of booking or deposit plus rest of the payment (cash or card payment )on the day of the appointment.

To make a Booking for beauty treatments, or to purchase gift cards, simply follow the steps set out on the Website

We will collect certain details from you during the Booking process or when you purchase gift cards. You agree that we will use those details in accordance with the terms of our Privacy Policy, which you can find here; https://soulbeautyacademy.co.uk/privacy-policy

The costs of our treatments will be shown on the Website and may be updated from time to time. If there are any changes made to our prices, those changes will not affect any Booking which has been made prior to the date of the introduction of the new prices

Gift cards are non-refundable.

Gift cards are valid for 12 months from the date of purchase.

All bookings must be made exclusively via our official website, www.soulbeautyacademy.co.uk  using the ‘Book Now’ button, which redirects to our booking platform. 

Alternatively, bookings can be made through the ‘Contact Us’ form on our website.

This policy ensures responsible booking behaviour and helps us maintain the highest level of service quality for all our clients. 

Also, to prevent no-shows, which can be unfair to both our other clients and our business. 

6.2 Accepted Payment Methods

We accept payment by bank transfer, debit card, Stripe, Cash.

Payment information will be provided to you via text message before confirming your appointment. 

6.3 Reservation of Appointments 

Upon placing a booking and receiving payment information, you have to complete the payment. 

Please be aware that timely payment is necessary to secure your appointment and avoid any inconveniences. 

6.4 Service Eligibility Criteria 

To ensure the safety and comfort of all parties involved, we kindly request that heavily pregnant individuals attend their appointments only if they are fit to retain throughout the session without any service disruption. 

Furthermore, individuals with nail infections/conditions unsuitable for service will be respectfully declined service to maintain the integrity and hygiene standards of our salon environment. 

6.5 Cancellation Policy

If you need to cancel your appointment, please note that we do not offer refunds. 

We kindly ask that you place your bookings thoughtfully. 

6.6 Rescheduling Policy 

However, we do offer the option to reschedule appointments under the following conditions: 

• Single and double service appointments can be rescheduled with a minimum of 48 hrs.  These rescheduling opportunities are available for each booking on a one-time basis. 

If you reschedule more than once per booking, the booking fee will be forfeited. 

In the event that you reschedule with less than 48 hrs notice depending on services booked, your prepayment will be forfeited, and a new payment will be required to book a new slot. 

We understand that unforeseen circumstances can arise, and we will do our best to accommodate them. However, please be aware that this policy is in place to compensate our artists’ time and protect our business. 

6.7 Lateness Policy 

At Soul Beauty and Training Academy, we value your time and strive to provide you with the best possible experience during your appointment. 

To ensure a smooth and enjoyable visit, we kindly request that all customers prioritize punctuality.

To uphold the quality of our services and respect the schedules of others, we have implemented the following lateness policy: 

• 10-15 Minutes Lateness: Any lateness within 10-15 minutes will incur a £10 lateness fee. In such cases, we will offer an alternative colour palette for your nail service to help catch up on time. However, no nail art will be offered during the appointment. 

• More Than 15 Minutes Lateness (Single Appointment): If you arrive more than 15 minutes late for a single appointment, your appointment will be cancelled, and the booking fee will be forfeited. 

We understand that unforeseen circumstances can arise, and we appreciate your cooperation in adhering to these policies. They are in place to ensure a seamless salon experience for all our valued clients. 

Thank you for your understanding and commitment to punctuality. 

6.8 Invoice Language: 

Customers consent to receiving invoices in English and are responsible for providing contact details for invoice delivery. 

7. TRAINING AND CONTENT USAGE

7.1 Introduction

Before enrolling in any of our courses, please carefully review our policies and terms and conditions (T&C) outlined below.

By purchasing and enrolling in our courses, you agree to abide by these policies and T&C. 

It is possible to purchase training services via the website. 

These Terms and Conditions apply to all training courses offered on this website. 

Users undertake to comply with generally applicable law and Terms and Conditions from the moment they start using the website. 

As part of using the website, it is forbidden to provide any illegal information, offensive or violating personal rights. 

7.2 Course Enrolment 

• To enrol in our nail courses, participants must meet the specified prerequisites (if any) and submit the required enrolment form via our contact form. 

• Payment must be made as per the course pricing and payment terms mentioned on our website in the chosen course description. 

• Course enrolment will be confirmed upon the successful payment of a 50% holding fee or full payment upon signing up and agreeing to the specified date. 

• Only participants aged 18 or over can take part in the training. 

• We reserve the right to refuse enrolment to any individual at our discretion. 

7.3 Agreeing Terms and Payment

• Agreement for the training services conducted by Soul Beauty and Training Academy may be concluded by purchasing the service directly through the portal https://www.soulbeautyacademy.co.uk

• It is also possible to sign up for the training directly at the premises of Soul Beauty and Training Academy or via direct bank transfer. 

• The contract is concluded on the condition that the price of the 50% holding fee and the rest of the course price is paid a minimum of 14 days prior to the course start date , which means that in the event of non-payment, the contract is automatically terminated. 

• Payment for training at Soul Beauty and Training Academy may be made in the form of:

a) Cash directly  b) Bank transfer  c) Website payment  d) PayPal  e) Stripe   

7.4 Rescheduling Policy 

• The booking fee is non-refundable and is not subject to change for another date or course unless 14 days’ notice is given – then the booking fee can be used to secure a new course. 

• Participants may reschedule a course once with a minimum of 2 weeks’ notice, subject to a £25 rescheduling fee. The rescheduled course date will be arranged based on available future dates convenient for the student. However, rescheduling more than once will result in forfeiting the holding fee, requiring a new full payment to secure a course date. 

7.5 Lateness Policy

• In the event of any lateness, the course day will not be extended, and it will proceed according to the specified times as originally outlined. 

• Any participant who does not show up for a part of the training or is late for more than 1 hour will be automatically refused further training with no refund to be made. 

7.6 Cancellation Policy 

• Cancellation by a participant is not permitted. The booking fee is non-refundable, and courses can only be rescheduled. Therefore, we kindly request that bookings be made thoughtfully. 

• Soul Beauty and Training Academy reserves the right to cancel the training for unforeseeable reasons. These reasons may include illness or random accidents, loss of the right to use the premises where the training was scheduled, or the occurrence of random accidents preventing the use of the premises where the training was scheduled (e.g., fire, flooding, lack of utilities such as electricity, etc.). In this case, participants who made payment have the option to use the same training at a different time, use the money for other training organized by Soul Beauty and Training Academy, or obtain a refund of the deposited funds. 

• If the training or service does not take place due to the fault of Soul Beauty and Training Academy, all previously paid costs will be fully refunded, or the date can be rescheduled for the next available time slot. 

• Soul Beauty and Training Academy may request the participant to leave the training (with no refund made as a consequence of holding a place for the training). This includes being under the influence of alcohol or drugs, using words commonly recognized as offensive, disrupting the course or the speaker, or interfering with the training process of the whole group. 

7.7 Training Content, On line courses and knowledge- based products and Participant Responsibility Clause 

• By participating in the training, the participant will receive knowledge covering the methodology of working with the scope of nail styling that the training concerns. 

This information will also be included in educational materials provided to participants (publications, educational products, etc.). 

• Soul Beauty and Training Academy does not guarantee the participants the assumed effect related to the subject of the training. 

Participants of training courses at Soul Beauty and Training Academy declare that they understand that they are purely educational. 

• The participant is solely responsible for how they use the methodologies presented to them, particularly if used contrary to trainer instructions. 

• Everyone participating in the training or service declares that they will not make any claims related to the training, service, or materials derived from it.

• Please note: Online courses and knowledge-based products are non-refundable once you have received the course materials or gained access to the platform. This includes

• Digital content

• Study materials

• Access to online learning resources

By purchasing an online course or knowledge-based product, you agree to these terms, and you acknowledge that no refunds will be issued after the materials are provided.

7.8 Liability and Disclaimers

• Soul Beauty and Training Academy is not responsible for any injury, loss, or damage incurred during or as a result of our courses. 

• Participants are encouraged to follow safety guidelines and best practices provided during the courses. 

7.9 Intellectual Property 

• Participants of all trainings organized by Soul Beauty and Training Academy declare that they will not record, reproduce or distribute in any form any parts of the training and the knowledge they will receive. 

• All training materials are intellectual property of their authors, are protected by copyright and made available to participants only for private use. 

• Training materials may not be sold, resold, or made available to the public to people who did not participate in the training. 

• Soul Beauty and Training Academy reserves the right to produce, reproduce and process videos, audio recordings, photos, and any other materials gained during the training. 

• Participants of all trainings organized by Soul Beauty and Training Academy declare that they agree to the recording of their image or voice, and in particular recording or photographing them. 

• They also agree to the publication of photos, audio/video recordings from the training and to the use of their name, image, voice. 

• They declare that they will not make any claims related to this or against it. 

• This is solely for the purpose of advertising the training and its outcome or any training-related actions, such as sharing the training gallery on Facebook or any other social media. 

• Soul Beauty and Training Academy will use photos, audio/video recordings, and other materials containing the name, image, or voice of the participants or clients only for promotional purposes, marketing, image, or training manuals. 

• Soul Beauty and Training Academy is in no way responsible for the unauthorized use or use of its logo, company content, publications, educational products, employee data, and company coaches by third parties for their own purposes. 

7.10 Privacy Policy 

• Please refer to our Privacy Policy for information on how we collect, use, and protect your personal information. 

7.11 Changes to Policies and T&C

• Soul Beauty and Training Academy reserves the right to modify these policies and T&C at any time. Participants will be notified of any changes. 

7.12 Contact Information, Invoicing, Certification 

• For any questions, concerns, or inquiries related to our nail courses, please use our contact form or contact us at info@soulbeautyacademy.co.uk

• Those purchasing services from Soul Beauty and Training Academy give consent to receiving invoices only in English. Therefore, those who want to receive an invoice are obligated to provide Soul Beauty and Training Academy with an email address and details for sending the invoice. 

• Make sure to provide the correct name while participating in the training. 

• A correction/duplicate of the certificate can be issued at an additional cost of £10. 

7.13 Final Provisions 

In matters not covered by these regulations, the relevant provisions of common law shall apply. These regulations constitute an integral part of the contracts concluded via the website.

8. BOOKING BEAUTY TREATMENTS AND PURCHASING GIFT CARDS

8.1 To make a Booking for beauty treatments, or to purchase gift cards, simply follow the steps set out on the Website.

8.2 The costs of our treatments will be shown on the Website and may be updated from time to time. If there are any changes made to our prices, those changes will not affect any Booking which has been made prior to the date of the introduction of the new prices.

8.3 We aim to provide all Services on time. However, should we need to cancel or postpone your appointment at short notice, we will make every effort to contact you in advance.

8.5 You may purchase gift cards through the Website for treatments which may be used by yourself or any other person (who meets the conditions set out in these Terms).

8.9 Gift cards are non-refundable.

8.10 Gift cards are valid for 12 months from the date of purchase.

8.11 Perfect finish Guarantee

At SOU , we strive to deliver a Perfect  Finish every time and are proud to offer the industry’s first gel manicure guarantee! It’s simple – if you purchase any of our gel manicures (GEL POLISH, GEL OVELAY, GEL EXTENSION) and experience any issues, for any reason over the following 7 days, we will happily fix it for free.

How do I redeem the guarantee?

9. SOUL BEAUTY & TRAINING ACADEMY RULES

9.1 Children aged 14-16 may have (nails ,waxing makeup  treatments but must have written parental/guardian consent – a form will be provided prior to treatment start time. A parent or guardian must also accompany any child aged 14-16 during their treatment. Any bookings cancelled due to non-compliance with this policy will be non-refundable. 

9.2 Minimum age of other treatments  : You must be 18 years of age or older to participate in training or receive services of permanent makeup.

9.3 No smoking is allowed in the Salon.

9.4 Clients must not be intoxicated on site. Should clients become intoxicated, Soul Beauty & Training Academy LTD  reserves the right to require them to leave.

9.5 When leaving or smoking outside, clients must be mindful of residential neighbours and keep noise to a minimum.

9.6 Should any clients be required to leave for a breach of these terms or any other reason at our sole discretion, any services booked or in progress will be cancelled and no refunds will be given.

9.7 Patch tests are required in advance for certain treatment types. The minimum time before treatment by which these patch tests must be completed is displayed when booking the relevant treatments. Patch tests are free. It is a customer’s responsibility to arrange for a patch test before treatment. If a customer arrives for a treatment and has not had a patch test as required, we reserve the right to refuse treatment and charge in full for the treatment. We reserve the right to cancel the booking of anyone who has not had a patch test within the required time.

9.8 All promotions including but not limited to discounted treatments are valid for the period of time specified in the promotion or 6 months, whichever is shorter. We reserve the right to terminate or revoke any promotion at any point.

10. CANCELLATION OF YOUR ACCOUNT

10.1 We reserve the right to suspend or cancel your account or registration at any time in our sole discretion without notice or explanation. We reserve the right to refuse registration or Booking at any time in our sole discretion without notice or explanation.

10.2 You may cancel your registration with us on at any time by emailing us at info@soulbeautyacademy.co.uk We will then remove your details from our system.

11. HEALTH MATTERS

11.1 By making a Booking or purchasing a gift card you are confirming to us that you have provided all relevant information to us in relation to the matters listed on the below at the time of booking in relation to all those persons who will be receiving any Services from the Salon.

Accordingly, you accept that we shall not be liable if any such matters or other relevant information are not disclosed prior to treatment. If such relevant information is not disclosed in advance and is either subsequently disclosed or suspected by Soul employees at their sole discretion, you acknowledge that Soul  may not be able to provide a treatment and, should service be refused due to non-disclosure, Soul  reserves the right to charge in full for treatments booked.

Examples of matters which must be disclosed to us prior to treatments:

  • If you suffer from any allergies or medical conditions (e.g. heart condition, high/low blood pressure, diabetes, viral, bacterial or any other type of infection) or have or have recently had any injury. This may mean that some treatments are contra indicated in part or in full.
  • If you have recently undergone an operation or received or are undergoing treatment for cancer or any other major medical condition within the last 5 years.
  • If you have bruising, rashes, swelling, skin tags, open sores or wounds, sunburn or have had sun exposure in the 48 hours prior, raised varicose veins, phlebitis, psoriasis, raised moles, undiagnosed bumps, athletes foot, verruca, fungal nail infection, ring worm, recent scar tissue, onychoptosis, pseudomonas, onychia, whitlow, fever, haemophilia, neuralgia, scabies, chilblains, recent broken bones or fractures.
  • If you are pregnant or trying to become pregnant.

12. YOUR CONTENT LICENCE

12.1 We may allow clients and visitors to the Salon to use our Salon’s photo booth to create photographic content. In addition, we may allow clients and visitors to the Website and our Social Media to post content on our Website or Social Media pages. The term “your content” means all works and materials (including without limitation text, graphics, images, audio material, video material, audio-visual material, scripts, software and files) that you create using our photo booth or submit to us or our Website or our Social Media or otherwise use for storage or publication on, processing by, or transmission via, our Website.

12.2 You hereby grant to us a worldwide, irrevocable, non-exclusive, royalty-free licence to use, reproduce, store, adapt, publish, translate and distribute your content in any existing or future media and to reproduce, store and publish your content.

12.3 You grant to us the right to sub-license the rights licensed under Section 12.2.

12.4 You grant to us the right to bring an action for infringement of the rights licensed under Section 12.2.

12.5 You hereby waive all your moral rights in your content to the maximum extent permitted by applicable law; and you warrant and represent that all other moral rights in your content have been waived to the maximum extent permitted by applicable law.

12.6 Without prejudice to our other rights under these terms and conditions, if you breach any provision of these terms and conditions in any way, or if we reasonably suspect that you have breached these terms and conditions in any way, we may delete, unpublish or edit any or all of your content.

13. YOUR CONTENT RULES

13.1 You warrant and represent that your content will comply with these terms and conditions.

13.2 Your content must not be illegal or unlawful, must not infringe any person’s legal rights, and must not be capable of giving rise to legal action against any person (in each case in any jurisdiction and under any applicable law).

13.3 Your content, and the use of your content by us in accordance with these terms and conditions, must not:

(a) be libellous or maliciously false;

(b) be obscene or indecent;

(c) infringe any copyright, moral right, database right, trade mark right, design right, right in passing off, or other intellectual property right;

(d) infringe any right of confidence, right of privacy or right under data protection legislation;

(e) constitute negligent advice or contain any negligent statement;

(f) constitute or promote any criminal activity;

(g) be in contempt of any court, or in breach of any court order;

(h) be in breach of racial or religious hatred or discrimination legislation;

(i) be blasphemous;

(j) be in breach of any contractual obligation owed to any person;

(k) be untrue, false, inaccurate or misleading;

(l) contain any instructions, advice or other information which may be acted upon and could, if acted upon, cause illness, injury or death, or any other loss or damage;

(m) constitute spam; or

(n) be offensive, deceptive, fraudulent, threatening, abusive, harassing, anti-social, menacing, hateful, discriminatory or inflammatory.

13.4 You must not use our Website to post any link to any Website or web page without our written permission.

14.WARRANTIES

14.1 We do not warrant or represent:

(a) the completeness or accuracy of the information published on our Website or Social Media;

(b) that the Website, Social Media or any Service promoted through the Website or Social Media will remain available;

(c) that any treatments you choose to purchase are suitable for you.

14.2 We reserve the right to discontinue or alter any or all of our Website services and any Services offered by the Salon at any time in our sole discretion without notice or explanation.

14.3 To the maximum extent permitted by applicable law and subject to Section 14.1, we exclude all representations and warranties relating to the subject matter of these terms and conditions, our Website and the use of our Services.

15. LIMITATIONS AND EXCLUSIONS OF LIABILITY

15.1 Nothing in these terms and conditions will:

(a) limit or exclude any liability for death or personal injury resulting from negligence;

(b) limit or exclude any liability for fraud or fraudulent misrepresentation;

(c) limit any liabilities in any way that is not permitted under applicable law; or

(d) exclude any liabilities that may not be excluded under applicable law, and, if you are a consumer, your statutory rights will not be excluded or limited by these terms and conditions, except to the extent permitted by law.

15.2 The limitations and exclusions of liability set out in this Section 15 and elsewhere in these terms and conditions:

(a) are subject to Section 15.1; and

(b) govern all liabilities arising under these terms and conditions or relating to the subject matter of these terms and conditions, including any Services which are purchased or received from our Salon, and cover all liabilities arising in contract, in tort (including negligence) and for breach of statutory duty, except to the extent expressly provided otherwise in these terms and conditions; and

(c) this includes any claims, losses or damages arising from the conduct of any employee, agent or contractor of Soul Beauty & Training Academy from who may perform any of the Services.

24.2 SOUL  discounts and promotions cannot be used in conjunction with any other offers, promotions, or discount codes.

24.3 SOUL  discounts, promotions, and vouchers (including free manicure vouchers) are valid for one-time use only and cannot be reused, transferred, or redeemed for cash.

24.4 Discounts and promotional codes are subject to specific expiration dates as stated in the promotion. Codes or offers presented after their expiration date will not be accepted.

24.5 SOUL reserves the right to modify, suspend, or revoke discounts or offers at its sole discretion without prior notice.

24.6 Any misuse or fraudulent activity related to discounts or promotions, including creating multiple accounts or sharing personal codes, may result in cancellation of bookings, forfeiture of the discount, and potential restrictions on future use of SOUL  services.

To ensure we provide a high quality service to all clients, arrivals more than 15 minutes after the scheduled booking time result extra charge.

PAYMENTS

 We  accept  cash, bank transfer ,website payment  by debit card . We accept Visa, Mastercard, PayPal , Stripe  

TELEPHONE BOOKINGS

We only take online bookings, making it super easy to check your appointment time once booked  and reschedule if/when life happens.

We do not take bookings or cancellations by phone but we have made it very easy to do both online – give it a try or ask one of our team in salon who would be delighted to help.

WALK INS

More than 90% of our appointments are made in
advance and so walk in availability is very limited! We recommend that all
clients book in advance.

FOOD

For the convenience of other customers we do not allow food to be consumed in the salon.

CHILDREN AND UNDER 16s

Ages 14-16:

Written parental/guardian consent is required for each child aged 14-16 receiving a treatment – a form will be provided prior to treatment start time. A parent or guardian must also accompany any child aged 16 or under during their treatment.. Any bookings cancelled due to non-compliance with this policy will be non-refundable.

Under 8s:

Children under the age of 14 are not permitted to have treatments. Children under the age of 8.

For safety reasons, children under the age of 8 are not permitted to be on the salon premises. This policy is in place to ensure a safe and comfortable environment for all our clients and staff. We appreciate your understanding and cooperation in adhering to this policy.

PETS

Clients are permitted to bring one small (under 5kg) well behaved dog with them into the salon. For the convenience of other customers, your dog must be kept in a dog bag while in the salon.
